David Robert Daleiden and Sandra Merritt, the illegal under cover 'investigators', have been charged with 15 felonies for violating the privacy of health-care providers. It seems it's illegal to manufacture fake ID's to gain confidence and access to someone's privacy and record confidential information without their consent. It's also illegal to highly edit film footage to present a political narrative to attack any institution (including Planned Parenthood) that is not supported with facts i.e, Planned Pararenthood 'selling body parts for profit', but that's a matter for a later Civil Court suit.
California's Attorney General Xavier Becerra said the use of manufactured identities to record private conversations is a violation of California's Constitution. “The right to privacy is a cornerstone of California’s Constitution, and a right that is foundational in a free democratic society,” Becerra said. “We will not tolerate the criminal recording of confidential conversations.”
you'd swallow an elephant and choke on a gnat.
The Miranda warning is a law that upholds a citizen's right to remain silent, and given by police in the United States to criminal suspects in police custody, before they are interrogated. It's purpose to preserve the admissibility of their statements against them in criminal court.
Citizens can't go about 'investigating' other citizens as criminal suspects, preserving statements intended to be used against them without informing them their communicating is being preserved for any reason, including suspected criminal activity. It's a violation of privacy and is in direct conflict of our Constitution that guarantees it's protection.
This matter is not a gnat. It is an elephant, in so much as it what these so called 'investigators' did is an attack a significant guarantee of our Constitution, our citizens right to privacy.
