Supreme Court Rulings: Update 06/26/2017

Postby GFunkMoneyDog » Mon Jun 30, 2014 9:54 am

Thats four for four. The first one shot down Obama's recess appointments. The second one force officers to request a search warrant before they can search your phone. The third one ruled that for profit businesses can hold religious views under federal law, and not be forced to provide contraception/morning-after pill to employees. Good job Hobby Lobby. The fourth one prevents public sector unions from making non union employees pay union dues.

Two Supreme Court rulings against President Obama. Someone should scurry to the golf course and tell him.

I suppose Obama will blast the Supreme Court at his next State of the Union Address.

1. It's a Constitutional win.
2. It's a Fourth Amendment win.
3. It's a Religious Freedom win.
4. It's a First Amendment win.

They are 5 for 5. The Supreme Court has ruled that Google has to face a class action lawsuit for violating the federal wiretapping law. Google's street view vehicle would scan neighborhoods for unprotected wifi connections and steal emails, usernames, passwords, images, ect, ect.

I support a workers right to collectively bargain. The union in the Harris case, was charging the Health Aids a fee that it was not entitled to receive, as they were not union members. The fact that the union negotiated higher wages for it's members that the non-union members benefited from, is a moot point. This has historically been the case. Unions are under no obligation to represent these employees that are not dues paying members. To charge a fee (the equivalent of dues), without providing representation is wrong. I agree with this Supreme Court decision.

The other 4 rulings?

Private industry should not have to pay for abortions, vasectomies, tubal libations or birth control if it is against their creed or religious belief belief. Contraceptives are not only used for birth control, they are used to treat uterine cancer and other female reproductive health issues. Where this is the case, an individual has other options. Those being obtaining employment where contraception is included in the medical plan, or paying for it themselves. That being said, this ruling is a two edge sword and has the potential to open a can of worms that put the health of the public at large at risk. For instance if a company ran by Christian Scientist choose not to include vaccines, or life saving surgeries, or treatment of contagious disease this case sets a precedent for a favorable decision.

As to the other two rulings, I am in complete agreement of the courts agreement in banning the search of an individuals cell phone. They were correct in determining this is a violation of constitutional rights.

With respect to Presidential appointments that by step Congress during periods of recess. Again this is a correct ruling. To allow any President this power would be to subvert how our government was set up to function. Two wrongs do not constitute a right. Congress (theoretically) is elected by the people. If a Congress refuses to work with a President, voters have the right to unseat them. We elect our Congress with the hope they will act in the best interest of the common good and national security of our people. Now we know that this is a myth in most cases, as campaign funding from Corporations and Special Interest groups have far more influence in Congressional elections as does the voter at large. Even so, the ultimate decision to place these individuals in seats of public power, and whether or not they are held accountable, rest with the voter.

In case you haven't noticed, party politics is what is destroying our country. Not that it matters. Me and the rest of old fogies won't around much longer anyway. I feel bad for the rest of you when the pitch forks come out.

The other three. What's your thoughts on them? Agree/Disagree?

Obama's recess appointments?
Require a search warrant before police can search your phone?
Google class action lawsuit for violating the federal wiretapping law?
